Ambient assisted living technologies are increasingly presented and sold as essential smart additions to daily life and home environments that will radically transform the healthcare and wellness markets of the future. An ethical approach and a thorough understanding of all ethics in surveillance/monitoring architectures are therefore pressing. AAL poses many ethical challenges raising questions that will affect immediate acceptance and long-term usage. Furthermore, ethical issues emerge from social inequalities and their potential exacerbation by AAL, accentuating the existing access gap between (...) high-income countries and low and middle-income countries. Legal aspects mainly refer to the adherence to existing legal frameworks and cover issues related to product safety, data protection, cybersecurity, intellectual property, and access to data by public, private, and government bodies. Successful privacy-friendly AAL applications are needed, as the pressure to bring Internet of Things devices and ones equipped with artificial intelligence quickly to market cannot overlook the fact that the environments in which AAL will operate are mostly private. The social issues focus on the impact of AAL technologies before and after their adoption. Future AAL technologies need to consider all aspects of equality such as gender, race, age and social disadvantages and avoid increasing loneliness and isolation among, e.g. older and frail people. Finally, the current power asymmetries between the target and general populations should not be underestimated nor should the discrepant needs and motivations of the target group and those developing and deploying AAL systems. Whilst AAL technologies provide promising solutions for the health and social care challenges, they are not exempt from ethical, legal and social issues. A set of ELSI guidelines is needed to integrate these factors at the research and development stage. (shrink)

The organ donor shortfall in the UK has prompted calls to introduce legislation to allow for presumed consent: if there is no explicit objection to donation of an organ, consent should be presumed. The current debate has not taken in account accepted meanings of presumption in law and science and the consequences for rights of ownership that would arise should presumed consent become law. In addition, arguments revolve around the rights of the competent autonomous adult but do not always consider (...) the more serious implications for children or the disabled. (shrink)

The EU offers a suitable milieu for the comparison and harmonisation of healthcare across different languages, cultures, and jurisdictions, which could provide improvements in healthcare standards across the bloc. There are specific ethico-legal issues with the use of data in healthcare research that mandate a different approach from other forms of research. The use of healthcare data over a long period of time is similar to the use of tissue in biobanks. There is a low risk to subjects but it (...) is impossible to gain specific informed consent given the future possibilities for research. Large amounts of data on a subject present a finite risk of re-identification. Consequently, there is a balancing act between this risk and retaining sufficient utility of the data. Anonymising methods need to take into account the circumstances of data sharing to enable an appropriate balance in all cases. There are ethical and policy advantages to exceeding the legal requirements and thereby securing the social licence for research. This process would require the examination and comparison of data protection laws across the trading bloc to produce an ethico-legal framework compatible with the requirements of all member states. The paper focuses on automation of signal processing, which also considers analysis of biomedical data, such as EEG. The results of the study prove that this enables a better understanding of signal changes and makes it possible to address some specific disturbances. It also makes it possible to describe the relevant changes in signals mathematically and helps to create markers of various brain disorders. This paper presents the study at the initial stage and focuses on the mathematical markers of concentration (...) disorders associated with Theta waves. The presented markers presented are based on Welch’s periodograms. The obtained results are very promising and further studies aimed at refining them are currently being carried out. (shrink)

In this position paper, we have used Alan Cooper’s persona technique to illustrate the utility of audio- and video-based AAL technologies. Therefore, two primary examples of potential audio- and video-based AAL users, Anna and Irakli, serve as reference points for describing salient ethical, legal and social challenges related to use of AAL. These challenges are presented on three levels: individual, societal, and regulatory. For each challenge, a set of policy recommendations is suggested.

Die Sophisten waren und sind umstritten. In der Zeit des Perikles, der Hochblüte der griechischen Kultur, als Wanderlehrer in Griechenland tätig, bewirkten sie mit ihrer Lehrtätigkeit, welche die verschiedensten Wissensgebiete umfasste, einen grundlegenden Blickwandel: Ihre Befassung mit Erkenntnistheorie, Rhetorik und Politik lenkte den Blick vom Kosmos zurück auf den Menschen. Indem sie den Menschen in den Mittelpunkt ihres Denkens stellten, ja ihn sogar zum Maß aller Dinge erklärten, wendeten sie sich zugleich gegen die traditionelle Sittlichkeit, die in der Regel religiös (...) begründet war. So waren sie für die einen gefeierte Aufklärer, für die anderen jedoch Zerstörer der Tradition. Diese Ambivalenz in der Einschätzung ihres Wirkens ist bis heute geblieben. Was auch geblieben ist und von Moderne wie Postmoderne aufgenommen wurde, sind wesentliche Ansätze ihres Denkens: z. Immer mehr Menschen in der Schweiz praktizieren Yoga, glauben an eine Wiedergeburt und lassen sich komplementärmedizinisch behandeln. Barbara Zeugin untersucht, wie sich dieser religiöse Wandel auf die Begleitung am Lebensende auswirkt. Insofern alternative Formen von Religion in der Schweiz zunehmen, ist es nicht erstaunlich, wenn in der Begleitung am Lebensende auch alternativ-religiöse Praktiken und alternative Heilverfahren sowie die entsprechenden Rationalisierungen immer mehr an Bedeutung gewinnen. Die Rekonstruktion einer solchen, als alternativ aufgefassten Sterbebegleitungspraxis führte die Religionswissenschaftlerin erstens in ein Hospiz (...) für schwer Kranke und Sterbende und zweitens in ein anthroposophisch-medizinisches Spital, wo sie beobachtend und fragend den folgenden Fragen nachging: Welche alternativ-religiösen Handlungsformen und Rationalisierungen spielen in der Begleitung am Lebensende eine Rolle? Welche Bedeutung wird alternativen Heilpraktiken zugeschrieben? Wie sieht die konkrete Begleitungspraxis aus? Pro-social basic human values and civic involvement. The moderating role of survival vs self-expression cultural context The present study investigated a hypothesis that the pro-social values differentiated by S. Schwartz's model of basic human values - universalism and benevolence - would positively predict civic involvement. Most importantly, authors expected that the type of pro-social value that would play a dominant motivational role would depend on moderating role of the level of self-expression and benevolence - cultural value dimension developed by R. (...) Inglehart. Based on discriminant function analyses performed on the data gathered in 17 European countries through the European Social Survey conducted in 2002, authors found that universalism predicts civic involvement only in self-expression countries, whereas the role of benevolence is rather neglectable and independent of the cultural context. The results are discussed with reference to cross-cultural differences in Europe. (shrink)

Celem artykułu jest ukazanie, jak, mimo ustalonych dawno temu postulatów, nakazujących „oczyszczenie” powieści kryminalnej z elementów fantastycznych i nadprzyrodzonych, motywy te funkcjonują we współczesnych utworach z tego gatunku. Jako kontekst należy wskazać zjawiska dające się zauważyć w najnowszej literaturze i kulturze popularnej. Jednym nich jest zmiana postrzegania typowych monstrów z horroru, które stają się zarówno „mniej groźne”, jak i „bardziej ludzkie”. Kolejnym – zakwestionowanie związku postaci (a także zespołu motywów) z fabułą. To na przykład, co było dotąd typowe dla horroru, (...) może pojawić się w powieści kryminalnej. Przeprowadzono analizę wybranych utworów dwojga współczesnych pisarzy: Katarzyny Puzyńskiej (Czarne narcyzy, Martwiec, Rodzanice i Utopce) oraz Wojciecha Chmielarza (Wampir, Zombie i Wilkołak) pod kątem występowania w nich motywów rodem z powieści grozy. We wszystkich omawianych tekstach to ludzie, a nie potwory są zabójcami. W utworach Chmielarza nazwy rodem z horroru to metafory ludzkiego zła lub szaleństwa (autor odwołuje się do zakorzenionych w kulturze znaczeń słów użytych jako tytuły). Katarzyna Puzyńska z kolei za miejsce zdarzeń wybiera małe, często prawie wyludnione miejscowości, gdzie wciąż żywa jest wiara w duchy, wampiry, nawiedzone domy (autorka odwołuje się między innymi do wierzeń słowiańskich). Ukazuje przy tym siłę ludzkich lęków (dotyczy to, w odpowiednich okolicznościach, nawet policjantów), jak również fakt, że istoty ludzkie potrafią być gorsze od potworów z fikcji literackiej. Motywy rodem z horroru funkcjonują w omawianych tekstach na kilka sposobów: 1) jako odwołania do doświadczenia odbiorcy, który odczytuje np. zaprezentowane w powieści nazwy w oparciu o własną wiedzę; 2) jako element lokalnej lub rodzinnej tradycji (żywy najczęściej w miejscach oddalonych od „centrów”); wreszcie 3) ucieleśnienie ukrytych w ludzkiej psychice obsesji i lęków, które niespodziewanie mogą się ujawnić. Medical tourists, persons that travel across international borders with the intention to access non-emergency medical care, may not be adequately informed of safety and ethical concerns related to the practice of medical tourism. Researchers indicate that the sources of information frequently used by medical tourists during their decision-making process may be biased and/or lack comprehensive information regarding individual safety and treatment outcomes, as well as potential impacts of the medical tourism industry on third parties. This paper explores the feedback from (...) former Canadian medical tourists regarding the use of an information sheet to address this knowledge gap and raise awareness of the safety and ethical concerns related to medical tourism. However, these ethical concerns are not discussed within the sources of information commonly provided to medical tourists, and as such, medical tourists (...) may not be aware of these concerns when engaging in medical tourism. This paper describes the methodology utilized to develop an information sheet intended to be disseminated to Canadian medical tourists to encourage contemplation and further public discussion of the ethical concerns in medical tourism.MethodsThe methodology for developing the information sheet drew on an iterative process to consider stakeholder feedback on the content and use of the information sheet as it might inform prospective medical tourists’ decision making. This methodology includes a literature review as well as formative research with Canadian public health professionals and former medical tourists.ResultsThe final information sheet underwent numerous revisions throughout the formative research process according to feedback from medical tourism stakeholders. These revisions focused primarily on making the information sheet concise with points that encourage individuals considering travelling for medical tourism to do further research regarding their safety both within the destination country, while travelling, and once returning to Canada, and the potential impacts of their trip on third parties. This paper looks at the issue of consent from children and whether the test of Gillick competency, applied in medical and healthcare practice, ought to extend to participation in research. It is argued that the relatively broad usage of the test of Gillick competency in the medical context should not be considered applicable for use in research. The question of who would and could determine Gillick competency in research raises further concerns relating to the training of the researcher to make (...) such a decision as well as to the obvious issue of the researcher’s personal interest in the project and possibility of benefiting from the outcome. These could affect the judgment of Gillick competency if the researcher is charged with making this decision. The above notwithstanding, there are two exceptional research situations in which Gillick competency might be legitimately applied: when the research is likely to generate significant advantages for the participants while exposing them to relatively minor risks, and when it is likely to generate great societal benefit, pose minimal risks for the participants and yet raise parental objection. In both cases, to ensure that autonomy is genuinely respected and to protect against personal interest, Gillick competency should be assessed by an individual who has no interest or involvement in the research. In this paper, we defend a representational approach to at least some kinds of non-human psychopathology. Mentally-ill non-human minds, in particular in delusions, obsessive-compulsive disorders and similar cognitive states, are traditionally understood in purely behavioral terms. In contrast, we argue that non-human mental psychopathology should be at least sometimes not only ascribed contentful mental representation but also understood as really having these states. To defend this view, we appeal to the interactivist account of mental representation, which is a kind of (...) a constructive approach to meaning. We follow Mark Bickhard in assuming that only an organism – either human or non-human – capable of detecting its own misrepresentations is representational. However, under his autonomy-based account of biological function these minds are incapable of misrepresentations because these minds are, ex hypothesi, unable to detect error in such representations. To solve this problem, we argue that adding a historical dimension – as in Millikan’s view on mental representations – to Bickhard’s account of function makes mental misrepresentation of mentally-ill minds possible. Using Bickhard’s dynamic account of function, it is possible to explain why delusions and other mental disorders can be seen as locally functional. However, an etiological dimension can further explain why misrepresentations seem to be globally dysfunctional. Even if representational or biosemiotic hypotheses about non-human psychopathology are difficult to confirm empirically, we defend the view that they can enrich our understanding of the causes and development of such pathologies, and may constitute a new progressive research programme. Tematem artykułu są nowe założenia w nauczaniu wiedzy okrajach niemieckiego obszaru językowego, zawarte w najnowszym curriculum dotyczącym tego przedmiotu. Cele, treści, metody, mierzenie postępu w nauce opierają się na czterech podstawowych zasadach: - integralności, która oznacza łączenie przekazywanych informacji z kompetencją językową i metodyczno-dydaktyczną; - łączenia i wzajemnego powiązania wiedzy z różnych dziedzin, np. realioznawstwo, kulturoznawstwo, historia itp.; - interkulturowości, tzn. rozwijania kompetencji, umiejętności, strategii w kontakcie z innymi kulturami; - ukierunkowania na działania, tzn. przekazywanie wiedzy nie w formie prezentacji (...) faktów, lecz na drodze indukcyjnej, także w formie projektów, wyjazdów studyjnych, kontaktów w kraju i za granicą. Nadrzędnym celem jest wykształcenie człowieka, który będzie dysponował nie tylko wiedzą z zakresu przedmiotu, ale także kompetencją fachowo-dydaktyczną, interkulturową i będzie w stanie samodzielnie interpretować zjawiska społeczne, polityczne i kulturowe w krajach niemieckiego obszaru językowego, a także we własnym zakresie uzupełniać swoją wiedzę. Ponieważ zjawiska te są w ciągłym rozwoju, nie należy zakładać, iż ogarnięty zostanie ich całokształt. Należy dążyć do naświetlenia różnorakich aspektów rzeczywistości społecznej z takich zakresów, jak np. jednostka i społeczeństwo, państwo i społeczeństwo, gospodarka, życie kulturalne itp. Przy ich omawianiu punktem wyjścia są doświadczenia i zainteresowania uczących się. Znajdują oni wspólnie takie tematy, które dają się rozbudowywać w różnych kierunkach w zależności od potrzeb i zainteresowań. Efektem takiego postępowania jest stworzenie nie listy obowiązujących tematów, lecz pewnej sieci wzajemnie z siebie wynikających problemów, którą ciągle można rozszerzać. Wdrożenie takiej drogi musi iść w parze z zastosowaniem różnorakich technik i metod. Powyższe curriculum uwzględnia także powstałą w ostatnich latach koncepcję nauczania wiedzy okrajach niemieckiego obszaru językowego nie w sposób sumaryczny, czyli omawiając kolejno te kraje i występujące w nich zjawiska, lecz w sposób zintegrowany i ukierunkowany na problem, tzn. odnosząc omawiane zjawiska do wszystkich krajów jednocześnie. In the article, composed of two parts with the titles Spektakl modernistyczny czy seans spirytystyczny? (A modernist spectacle or a spiritistic seance?) and Dlaczego Słowacki niszczy konterfekt księcia Józefa? (Why does Słowacki destroy the portrait of Prince Józef?), presents a contextual interpretation of Jan Lechoń’s poem Duch na seansie (A Ghost at a Seance). The author questions the opinion, which was widespread in literary criticism, that Lechoń together with other members of the Skamander group discredited Romantic poetry and national mythology (...) on the threshold of independence. The analysis of the poem made in the article leads to the conclusion that the poet fought stereotypes deeply rooted in public opinion, which in the eyes of the general public were also reinforced by Slowacki’s poetry. Thus, Słowacki appears at the seance to demystify a belief in the messianic, necrotic and patriotic tone of his poetry, in the bard-creator of the national Gospel, who is endowed with the power to discover absolute truths, and in the „master of the word” as well as the „creator of artistic beauty” as well as the only generally-accepted opinion. Optimistic signs of revival have dominated the symbols of suffering, the talkativeness has been replaced by silence, the word by the iconoclastic deed, the mystical heat by ironic distance. The symbols, images, references to literary texts and other signes of culture help to create a revalued portrait of Słowacki and mould a myth of gray heroism, which is a complete contrast to the myth of the „colourful uhlan”. The destruction of the portrait of Prince Józef Poniatowski and a reference to Piłsudski found in the last line of Karmazynowy poemat (The Crimson Poem) are the signs of the ideological declaration of the young poet, who referring to great Romantic tradition, discovers new and new meanings.
